Hello Lee & welcome to the forum.
Sorry for the delay - I've been busy in other directions for the last few days.
There are two options here - and this answer only relates to the AE situation - any business arrangements regards taxation etc would need to be dealt with seperately.
The first option is to submit an application to VOSA to form a partnership AE between father & son. In this case the son should attend the MOT Managers course.
This application would require certain paperwork to be submitted to VOSA, all of which is explained on the VT01 application form, and you could of course seek advice by contacting your local VOSA office on this one.
This could be done as a 'seamless transfer, without any interruption to testing.
The downside of this is that the process would have to be gone through again if anything happened to father.
The second option is that the son applies to become AE in his own right, as a sole trader. The same application process would have to be gone through, but again this should be a 'seamless transfer' the plus side of this is that ths process needs only happen once.
I'm afraid that the 'grandfather rights' is rapidly becoming a thing of the past

grand father rights option No sutch thing. Testing will have to stop and his son would have to apply again as a new A/E applicant.

There are all sorts of "Legal Issues", related to your question,
Is This? a Forum, which predominantly tries to advise posters about anything related to vehicle inspections. (MOT`S)?
As far as I understand, the "Legal Section", is to advise, "Nominated Testers" or "Presenters", Or "AE`s" on how they may make an appeal? or contest it.
"If" Your "Boss" Has Not Had Enough Sense To" Gradually"," Pass Over" The "Reins" to His Son, allowing Him to be a partner in "The Business", and Encourage Him to attend various courses to enable Him to become an "AE"?
Then, Sadly, All Will Be Lost To The "Tax Man"!

my boss is a sole trader and has just had his 76th birthday. As i understand if (god forbid) he dies the garage will have to stop testing. He has a son who is a NT at the garage, and thinks that if the worst happened the grand father rights option would kick in and his son would become the AE so we could carry on testing. I can not find anything in black and white to say that this would be the case. Please could someone clear this issue up for me.
