cheers wes mate cant get a punter to sign a disclaimer as this brings testing scheme into disrepute anyhoo got a job interview on monday...back to the nuts and bolts more money less hours and no hassle from vosa hopefully..win lose or draw can't see myself testing much longer...way far too much politics in mot's nowadays....screw road safety lets see how much we can earn for the govt. sorry but not me anymore

I don't think you can get the customer to sign a disclaimer. I remember this being talked about at the time when the DSM test was brought in. Just as you have no power to stop them driving away from the VTS with a vehicle you've issued a VT30 with a dangerous to drive.

what about fibre glass on rear chassis where axle bolts onto don't want to rip axle off during brake test which could leave you wide open
I think it would have done that before it arrived at the test station, however if I saw something like that I would get the customer back in and inform him of the dangers of carrying out the test and would he like me to carry on or even sign a disclaimer.

I would argue the case, reading the lastest special notice they say once again in bold text a tester has the right to refuse to test if they thinks there is a danger etc. Just because VE man (ex baker) does not agree that doesn't make it right.
Why give us the option of refusal to test in the first place if decissions overturned by someone else with little experience.

I must admit I woouldn't do a refusal to test on sharp edges I would just do the test and fail it, but I'm different being a sole trader and the only tester, It wouldn't be in my interest to wind customers up.

interesting..just really peeves me off after testing thousands of cars over twenty years without a blemish to get treated like a silly wee boy by both VE and local area office over this one....the saga continues

The appeals team in VOSA's Bristol HQ will carefully consider all the facts and arguments. You can either do it in writing or seek a hearing. Written method is quicker.
Your previous warning has probably not helped, but the appeals team will treat your case fair and square. About 20% appeals are overturned, so don't go looking for another career option just yet!!
PS They have the powers to quash any unfair warnnigs/debit points to both you and the AE.

It can be 50 points but you cant get a ban, check the flow chart. whats your history.

got my letter in today 50 points and a ban dammed if you do and dammed if you dont...free advice for anyone that wants to become a tester...DONT...20 trouble free years and now this...a fecking joke

i personally think that their should be an rfr for vehicle presenters attitude. few times ive had abuse from presenters for failing their car, refuseing to test etc. And we get loads of gypsy's coming to our garage and you dont want to go upsetting them! i do manage to calm them down tho, by telling them "hey, could be worse, could be my car" oh they love that lol

An Appeal test is where the vehicle presenter submits a car which fails, and the presenter thinks it should have passed.
VOSA will then collect a full MOT fee as a deposit, and re-test the car. The car is re-tested at the VTS which issued the failure in order to ensure consistency as far as is possible - ie the same roller brake tester as originally used, the same headlamp aim tester- ATL/non ATL etc.
If the VE's examination finds the same results as the tester - the original faiure defects were justified, then VOSA collects the test fee.
If the vehicle should have passed, the VE will then issue a VT20, and may then take action against the tester & AE for incorrect standards. In this case the test fee is normally refunded.
An inverted appeal is the opposite, a VT20 is issued and the presenter thinks it should have failed.
In this case no fee is taken by VOSA, and, if appropriate, action is taken against the tester & AE for those defects found which should have failed.
